CFTC Rule 4.41 prescribes the wording that has to accompany hypothetical or simulated performance
results.
Every number this product is designed to produce is simulated, so the notice accompanies all of
them, on the site and in the app, reproduced word for word rather than paraphrased.
What the prescribed text says, in short: these are simulated or hypothetical results, and they carry
certain inherent limitations. Unlike an actual performance record, they do not represent real
trading. Because the trades were never executed, the results may have over- or under-compensated for
the impact of market factors such as a lack of liquidity. Simulated programs are also designed with
the benefit of hindsight. And no representation is made that any account will achieve, or is likely
to achieve, results similar to the ones shown.
